Terms & Conditions

Musicians wishing to submit music to Umbrella Radio and/or Umbrella Radio should read over the following Terms and Conditions, and then download the form at the bottom of the page.  Follow the directions on the form, and mail it to the address on the form, and we’ll be in touch!

1. Music Submitted is played royalty free on Umbrella Radio’s Audio Stream (See section 5).  In exchange Umbrella Radio will also build Affiliate links to Amazon.com and iTunes to improve the sales of music submitted to Umbrella Radio.

2. All unsolicited submissions to Umbrella Radio will be assessed an upload fee of $1.00 dollar per recording not to exceed $12.00 dollars per album title. New artists must submit at least 10 songs for consideration. Musicians with music on Umbrella Radio and Solicited Musicians are exempt from this fee. Unsolicited submissions are not guaranteed broadcast air play but will be added to the affiliate links with Amazon.com and iTunes to improve sales of music submitted to Umbrella Radio. Links will only be made if the artist has music on Amazon and Itunes. We do not sell your music, only link to music for sale by artist. Checks / Money Orders Payable to Mill Valley Cultural Arts Umbrella, Mail check with Music CD and a signed copy of this form completely filled out. We are not responsible for returning any physical music discs or for submissions lost in the mail.

3. The submitting party must be an independent unsigned Musician / Band / Artist. Umbrella Radio withholds the right to determine eligibility of an applicant’s claim to this assertion, and in rare cases we can make a special exception to this rule.

4. The Submitting Party / Musician / Band /Artist is the sole owner of all copyrights and intellectual property rights associated with the material being submitted. The submitting party / copyright owner must also agree that nothing submitted includes any content which infringes upon any copyright or any intellectual property right or trademark of any company, entity, or any person living or dead. The submitter recognizes and confirms that the submitter is solely legally responsible and accountable for the recorded material being submitted. NO COVER MUSIC ALLOWED!

5. Umbrella Radio has the right to use the submitted material, the CD cover art and liner notes associated with the submitted material completely royalty free for use in broadcasting and public play (includes but not limited to: DJing at events, fund raisers and Street festivals, audio stream broadcast, web site promotions, etc). The Mill Valley Cultural Arts Umbrella, Inc. owner of Umbrella Radio its agents, its employees, its subcontractors and its board members are not subject to any royalty collection by any entity in relation to the music or material being submitted. Umbrella Radio has the right to broadcast all or only a selection of recordings submitted. Umbrella Radio has the right to remove music from our Umbrella Radio play list at any time without warning or notification for any reason.

6. All material submitted for broadcast must be original recordings must be written, produced, composed, and performed by the musicians, artists or performers submitting the recordings. No “Cover Music” is allowed even if you have the right to use it, only original music can be submitted. NO COVER MUSIC, NO EXCEPTIONS! If a submission contains Cover Music on the CD being submitted, please exclude that track listing from page 1 of this Music Submission Release Form and we will exclude that track from broadcast. The submission of “Cover Music” as your own music will cause a forfeiture of upload fees and the rejection of all of your music from broadcast.  Cover music is considered any music not originally created by the submitting artist (See section 4); traditional music may be exempt if over 100 years old and proven to be in the public domain. Umbrella Radio will research all traditional music for eligibility and any determination of eligibility is final.  Artist Submitting Traditional songs must note them as such or it will be treated as Cover Music.

7. The submitting party can request to have their recordings removed from broadcast play list through written submission. Umbrella Radio has the right to continue broadcasting the material for one week after receipt of the written request. Please send written requests to the address provided at the bottom of the page.

8. The submitting party must request to have their material withdrawn from the broadcast play list when the submitter no longer solely controls the copyright of music / recordings and materials provided. It is solely the responsibility of the submitter to notify Umbrella Radio in writing in advance of any change in their ownership status as sole copyright owner and sole intellectual property owner of any music / recordings and materials provided. The Mill Valley Cultural Arts Umbrella, Inc. owner of Umbrella Radio, its agents, its employees, its subcontractors and its board members are not responsible for any royalties by any entity associated with any changes in ownership status of recordings and materials being submitted without prior written notice of the change in ownership status. Umbrella Radio holds the right to continue broadcasting the material royalty free for one week after the receipt of the written change in ownership status.

Disclaimer for Music

The purpose of Umbrella Radio is to provide a venue / outlet for budding local and regional musicians, artists and performers so that their music, recordings and performances can heard by the general public.  Umbrella Radio will never play music or recordings by artists or musicians who have not signed a release with us to do so, and who are not from the Baltimore area.  Umbrella Radio will legally protect it’s right to broadcast local original music, original recordings and original performances from local musicians, artist and performers.

No  music, lyrics, poetry, written compositions, musical compositions, literary readings, theatrical readings or recordings thereof infringes upon the copyright or any intellectual property of any person, company or entity by Umbrella Radio or by the musicians, artists and performers submitting said material to Umbrella Radio for audio streaming use.   All independent music played on this streaming audio station is donated by local artists,  performers, and musicians who are the sole copyright and intellectual property owners and creators of the original material.  The submitting artists, musicians and performers have signed a Release Form stating such, and they have granted Umbrella Radio the right to play said material in whole or in part completely royalty free.  Also, all program sound bits, promos, tags and sound loops arecreated in-house by Umbrella Radio and are the sole ownership of Umbrella Radio.
